HOW HIGHLY RELIABLE CRPS COULD MITIGATE AN IMPENDING MALPRACTICE CRISIS

Rising costs, excess judgments, and COVID-related stresses are creating growing challenges for health care organizations and liability insurers that may be setting the stage for a medical professional liability (MPL) crisis similar to that of the early 2000’s. Communication and Resolution Programs (CRPs), pioneered by organizations such as the University of Michigan, are experiencing widespread implementation, and, if properly implemented, offer a potent tool to combat the dynamics of this hardening MPL market.

Building on the foundation of a growing number of apology & disclose, provider support, and early resolution programs, CRP programs provide a comprehensive, systematic and principled approach that ensures that supporting patients, families and caregivers after harm—from rapid and empathic response and sincere expressions of reconciliation including financial and non-financial restitution, to assurance of efforts to prevent future harm to others—becomes the norm rather than the exception.

But achieving the clinical and financial benefits of CRPs involves using new tools and resources to ensure highly reliable implementation, and addressing challenges associated with adapting CRPs to different practice delivery and liability insurance environments.

This session will present options for effective CRP implementation gleaned from over 400 health care organizations, providing new strategies for addressing persistent challenges that threaten our health care and liability systems.
